Have moving violations, will travel
"Don't worry. The points won't show up on your license back in New Jersey."
Bill Lozier swears that's what the Florida cop said when handing him a $130 speeding ticket.
What a relief! Points can mean insurance surcharges.
So how come the New Jersey Motor Vehicle Commission recently notified him that six points were being added to his license?
Six! That's half the 12-point limit that mandates license suspension.
"Florida must be changing its policy," reasoned an angry Bill. "A lot of people are going to be affected by this change."
By "people," Bill meant snowbirds like him who split their time between Florida and Bergen County homes — except there hadn't been a policy change.
Florida and New Jersey share driving-penalty information, said an NJMVC spokesman. A spokeswoman for the Florida civil court system confirmed that "Tallahassee [the state capital] requires reciprocation."
Might some local police departments fail to report all tickets to the state motor vehicle office?
"That's possible," she said.
Bill had his own assessment.
"Now we know that what's said when you get a ticket is not necessarily true," he concluded.
But there's good news here: New Jersey accepts only two points for each out-of-state violation. So a four-point speeding ticket generates just two points back home.
So why did the notice Bill received from the NJMVC assess him six points instead of two PLUS a $150 surcharge?
It turns out that there were two earlier moving violations – one more from Florida in 2008 and one from Virginia in 2009. Each of these three offenses generated two points, and when the total hit six, New Jersey assessed him a surcharge beyond anything meted out by his insurance carrier.
Snowbirds, beware. Breaking motor vehicle laws in warmer states can lead to cold consequences several months — even years – later when you open your mailbox and learn that penalties have finally reached home.
Here are more confusing issues that are puzzling readers:
Q. Isn't the Click It or Ticket campaign simply a way for government to finance overtime duty for favored police officers? Wouldn't law enforcement be more effective if cops focused on seat-belt offenses year-round? B.R., Wood-Ridge
Consistent year-round enforcement for any offense probably would be more effective. But the National Highway Traffic Safety Administration, which funds this program, recognizes that local police resources are limited and other law enforcement issues — especially emergencies — take priority most of the time. So campaigns to enforce laws covering seat belts, drunken driving, distracted driving and other violations are organized in tandem with public service messages to build awareness of these safety issues at key times during the year.
