Tensions Run High, Very High, at Wisconsin Supreme Court

The Wisconsin Supreme Court is arguably the most interesting high court in the nation. That is not necessarily a good thing.

The court is split between four justices who lean to the right and three who lean to the left. That sets the stage for tension, which has been stoked in recent years by rancorous contested elections for the court.

Before we cover the latest intrigue, which involves rumors that one justice put another in another a chokehold, let’s review some recent news items.

The justices in 2009 and 2010 battled fiercely — and personally — over whether conservative justice Michael Gableman should be recused from criminal cases, due to allegations that he expressed hostility to the rights of criminal defendants when he campaigned for the court in 2008. The justice avoided disqualification and has denied prejudice. But the debate got so nasty that at one point conservative justice David Prosser conceded calling the court’s liberal chief justice, Shirley Abrahamson, a slur used against women, according to this account in the Milwaukee Journal Sentinel.

The court’s seven members had another fierce internal struggle last year over whether the court should adopt strict rules to disqualify themselves from hearing cases involving their campaign contributors — an idea ultimately rejected.

Earlier this year, we covered the tense, neck-and-neck campaign battle between Prosser and his liberal challenge JoAnne Kloppenberg, which Prosser ultimately won.

And there’s this: When the justices on the court meet to discuss cases they sometimes begin with a strange ritual. N. Patrick Crooks, a veteran of the court, told the Law Blog that he will pull out a newspaper and do a dramatic reading of his colleagues’ horoscopes. He said it’s a strategy designed to lighten the mood on the court.

Onto the latest. Justice Ann Walsh Bradley told the Milwaukee Journal Sentinel over the weekend that Prosser allegedly put her in a chokehold during a recent dispute. Click here to read the account.

“The facts are that I was demanding that he get out of my office and he put his hands around my neck in anger,” she told the newspaper. “Those are the facts and you can try to spin those facts and try to make it sound like I ran up to him and threw my neck into his hands, but that’s only spin.”

Prosser released a statement denying the allegations, AP reports . “Once there’s a proper review of the matter and the facts surrounding it are made clear, the anonymous claim made to the media will be proven false,” he said. “Until then, I will refrain from further public comment.
