No Easy Fix

Many jurisdictions throughout the country require that pets be licensed, a process that includes a surgery to be spayed or neutered. Alabama's lack of pet licensing laws—and low numbers of spayed and neutered pets—has resulted in an abundance of adoptable cats and dogs, making the state a pet-adoption destination. In recent years, several spay/neuter clinics opened around the state, offering the surgeries at low cost. On June 9, without any prior notice, the Alabama Spay/Neuter Clinic in Irondale received a cease and desist letter from the Alabama State Board of Veterinary Examiners (ASBVE).

For the past three years, the clinic at 2721 Crestwood Boulevard has offered low-cost spay and neuter surgeries for cats and dogs, one of three 501(c)3 clinics in the state offering these cost-effective services. (The other two are in Dothan and Montgomery). A fourth clinic, North Alabama Spay/Neuter in Huntsville, was shut down by the ASVBE in May for what the clinic's director, Brenda Gallagher, says she thinks is the same reason the state board is threatening to close the Irondale clinic—the ASVBE's allegation that the clinic is not owned by a licensed veterinarian.

Mark Nelson is Alabama Spay/Neuter's executive director. Nelson owns the facility's equipment and oversees the clinic's support staff. The two licensed veterinarians at the facility who perform spay and neuter surgeries, however, are employed and managed by Dr. William B. Weber, a licensed veterinarian who has owned the non-profit clinic practice for the past year. Weber also owns his own private practice, Eastwood Animal Clinic. Alabama Spay/Neuter leases the building in which it operates from an unnamed individual.

Seeing a need for low-cost spay and neuter services to locally reduce the number of stray animals, Nelson opened the clinic in June 2008 in a double-wide trailer in Irondale. In September 2009, Alabama Spay/Neuter moved into its present housing, a 6,700–square foot, state-of-the-art facility that features four surgical suites capable of performing approximately 100 surgeries each day (once the number of vets on duty is expanded to four). Over the past three years, some 33,000 pets have been fixed here at reduced rates. The clinic serves a 13-county area (Jefferson, Tuscaloosa, Walker, Cullman, Blount, Bibb, Chilton, Shelby, St.
